PROMOTION – TERMS AND CONDITIONS

Promoter

1. This promotion (“Promotion”) is being conducted by: Poolwerx NZ Pty Ltd (ABN 15 010 579 674) Address: 10 Camford Street, Milton, QLD Australia 4064

Prize

2. This promotion is known as the “Poolwerx Win a Family Holiday to the Gold Coast” (“the Promotion”).

3. A total of ONE (1) prize will be awarded to residents in New Zealand who satisfy the entry conditions

4. Prizes cannot be exchanged and the constitution of monetary value remains at the Promoter’s discretion.

5. Prizes are non-transferable including dates for travel.

6. Details of the prize are:

a. ‘Win a Family Holiday to the Gold Coast’

i. Holiday Dates 14 March – 21 March 2026.

ii. Return flights for 4 people flying economy to the Gold Coast, QLD from any New Zealand commercial airport. Should direct flights not be available, flights may including multi-stops

iii. 7 nights accommodation at the Mantra Crown Towers in Surfers Paradise in a two-bedroom apartment.

iv. $AU 500 Spending Money given as a visa card voucher before the holiday start date

v. Bookings for flights and accommodation only to be arranged by Poolwerx

b. Transfers and any additional fees for visas, passports are payable by the winner.

Duration of Promotion

7. This Promotion commences at 10am (AEST) 20th October 2025 and closes at 11.59pm (AEST) on 30 November 2025 (Promotional Period).

Eligibility

8. To be eligible to enter, individuals must be 18 years of age or older, reside in New Zealand and populate all mandatory fields in an electronic entry form, including by providing a valid e-mail address, mobile phone number, their name, physical address and Poolwerx invoice number from their purchase made during the Promotional Period. The purchase must be a minimum spend of NZD$50 and may be of any product or service available at Participating Locations. For the purposes of this Promotion, Participating Locations are Poolwerx franchisees who advertise this Promotion during the Promotional Period and are located within New Zealand. This promotion is not open to Australian residents.

9. No employee (or any immediate family member of that employee) of the Promoter or any of ‘related body corporate’ (as that term is defined in the Companies Act 1993 of the Promoter or of any franchisee of the Promoter is eligible to enter this Promotion. The words ‘immediate family member’ includes any of the following relations: spouse, ex-spouse, de-facto spouse, child or stepchild, parent, stepparent, grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister or cousin.

How to enter

10. Information on how to enter the Promotion forms part of the terms and conditions of entry. Entry into the Promotion constitutes acceptance of these terms and conditions.

11. To enter, individuals must visit the Poolwerx business website, enter the required details and submit the fully completed entry form so it is received during the Promotional Period.

12. Entries to the prize draw are limited only to purchases completed and submitted to Promoter (Poolwerx Franchise) within the Promotional Period. Each Poolwerx transaction with a minimum value of NZ$50 entitles a participant to enter the Promotion, and each participant must declare the invoice or receipt number as proof of purchase on the website entry form. Any entries submitted outside of the Promotional Period will be disregarded by the Promoter.

13. Incomplete or indecipherable entries are invalid.

14. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from any person who has tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion are fully reserved.

15. If there is a dispute about the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

Prize Draw

16. Entries will be drawn at 10 Camford Street, Milton QLD 4064 at 10:00am (AEST) on Friday 5 December 2025 (Prize Draw).

17. Winning entry (“Winner”) will be drawn at random by a software application, using data from all entries received on https://www.poolwerx.co.nz/promotions/win/ and verified by Promoter and or its agents. All entrants have an equal chance of winning a Prize and the Winner will be determined totally by chance.

18. The Winner will receive one Prize and at the discretion of Poolwerx.

19. The Winner does not need to be present at the Prize Draw.

20. The Winner will be published on Poolwerx website from 3.00pm (AEST) on 12 December 2025, and the respective Winners will be notified in writing by email and by phone by no later than 5.00pm (AEST) on 19 December 2025 (AEST).

21. The Promoter reserves the right to request a Winner to provide proof of identity in order to claim the Prize. Proof of identification considered suitable for verification is at the discretion of the Promoter. If a Winner cannot provide proof, such person may forfeit their allocated Prize in whole and no substitute will be offered by the Promoter.

22. If the Prize is unclaimed by 5 January 2026, an unclaimed Prize draw will be conducted at 10 Camford Street, Milton QLD 4064 at 10:00am (AEST) on 8 January 2026. (Unclaimed Prize Draw).

Cost of entry

23. No fees are payable by eligible entrants to enter this Promotion however there is a minimum spend of $50 NZD on Poolwerx goods or services.

24. All entries become the property of the Promoter.

25. The Promoter collects, stores, processed and discloses ‘personal information’ (as that term is respectively defined in the Privacy Act 1988 (Cth)) and the Privacy Act 2020 ( NZ) in order to conduct the Promotion and may, for this purpose, disclose an entrant’s personal information to third parties, including but not limited to agents, contractors, service providers and Prize suppliers. Entry is conditional on each individual providing personal information in the manner described in paragraphs 7 and 10 above. All personal information supplied to the Promotor in connection with this Promotion will be handled strictly in accordance with the Promoter’s privacy policy, which can be viewed here: https://www.poolwerx.co.nz/privacy-policy/

26. In addition, the Promoter may use personal information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The privacy policy also contains information about how entrants may opt out, access, update or correct their personal information.

27. By entering this Promotion, each entrant acknowledges and agrees that their personal information provided on entry will be collected, stored, processed and disclosed by Poolwerx or its Related Entities or Consultants for the purposes described in these terms and conditions.

28. Each Winner grants to the Promoter an exclusive, perpetual, royalty-free, worldwide license (with the right to sublicence) to use their name, image, voice and likeness (the Licensed Rights) in media for the purpose of promoting the Promotion or any other social media, website or other forms of marketing of Poolwerx services. No fee will be paid to any Prize Winner for the Licensed Rights.

29. In consideration of the right to enter this Promotion, each entrant unconditionally and irrevocably assigns and transfers to the Promoter all right, title and interest in and to all copyright in any material created pursuant to that person’s participation in any aspect of this Promotion.

Limitation of liability

30. By entering this Promotion, each entrant accepts full responsibility for their decision to participate in the Promotion. Each entrant irrevocably and unconditionally releases, forever discharges and waives any right to make a claim against the Promoter and its directors, officers and personnel in respect of any loss, liability (including liability for negligence), cost or damage of any kind suffered or incurred by an entrant as a result of, or in connection, with the acceptance of, and participation in, the Promotion.

31. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, loss of data, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserve the right to take any action that may be available to it at law.

32. If for any reason this Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which affect the administration, security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Promotion, subject to obtaining the prior consent of any relevant gaming authority

Redeeming the Prize

The prize will be sent electronically to the winner’s email address. Each Winner may be required to appear at a Poolwerx location for a promotional photograph.
